He claimed he changed his residence from Gambrills to Pasadena in order to challenge incumbent Del. Gary Simmons (D-Anne Arundel). The Supreme Court of Maryland affirmed a lower court ruling striking him from the ballot on April 13, 2026. His attorney Tiffany Alston represented him during the legal proceedings. This was the second time in two weeks that the high court issued a ruling on the case.
The Maryland State Board of Elections struck Dove from its list of candidates for the district after the Supreme Court ruled he was ineligible to run. Judge Robert J. Thompson described Dove as having fallen victim 'to bad timing,' juggling various situations regarding possible renovations of a home in his new district and the one where he has lived for years. The court noted that Dove had not perfected moving to Pasadena despite claiming he changed residence.
